Welcome to theaigo.com. These Terms of Service (the "TOS") set forth the legally binding terms for your use of theaigo.com and any of our online channels, platforms, products, or services, including all content contained therein ("Services"). The Services include any affiliated website to which you may be redirected from theaigo.com.

The Services are owned and operated by New Verve Limited, a company duly incorporated in the United Kingdom, having its registered address at 86โ€“90 Paul Street, London, England, EC2A 4NE, and registered with Companies House under number C107181.

By accessing and/or using the Services, you agree to be bound by these TOS and all other policies published on https://theaigo.com/legal-information as updated from time to time ("Policies"). If you do not agree with these TOS or our Policies, you must immediately cease using the Services.

Our Services are intended solely for personal, non-commercial use. You agree not to use the Services for any commercial, illegal, or unauthorized purpose. For the purposes of these TOS, "you" and "your" mean you as the user of the Services.

All conversations between users and AI Companions on the Services are entirely fictional. The AI Companions are artificial intelligence characters designed to simulate human-like interactions. They do not possess emotions, intentions, or the ability to fulfill real-world promises. Any elements resembling reality, including offers of real-life meetings or commitments, are fictional. New Verve Limited does not assume responsibility for misunderstandings arising from such interactions.

1. General

The Services are an online chat platform using artificial intelligence ("AI") to generate virtual characters ("AI Companions") with whom you can interact. The Services may include media such as images, videos, and voice notes. Some features may require account creation and/or a paid subscription.

1.1 Account

Certain features require you to create an account using an email and password or other supported login method.

We may suspend or terminate accounts at our sole discretion if we believe you have violated these TOS or any Policies. New Verve Limited is not liable for costs or losses arising from account suspension or termination.

1.2 Subscription

Some Services are available only to paid subscribers. Subscriptions begin after initial payment and renew automatically unless canceled. You are responsible for payment of all fees, charges, and taxes. We are not liable for costs arising from third-party platforms not indicated or recognized by us.

1.3 User Safety

User safety is a priority. Do not disclose sensitive personal information, including financial data, addresses, or passwords. You are solely responsible for protecting your information and assume risks associated with online communications. Suspicious or inappropriate behavior should be reported to contact@newverve.co.

3. Intellectual Property

All intellectual property rights in the Services, including technology, designs, AI characters, content, logos, and trademarks, are owned by or licensed to New Verve Limited. You are granted a limited license to use the Services for personal purposes only. Unauthorized use is prohibited and may result in account termination and legal action.

While using the Services, you may provide input ("Input") and receive AI-generated output ("Output").

We use automated and human moderation to enforce these TOS and Policies. Content that violates rules may be removed, and accounts may be suspended. Moderation may also alter user requests before output is generated. Concerns can be reported to contact@newverve.co.

5.5 Prohibited Content Reporting

We maintain a zero-tolerance policy for Child Sexual Abuse Material (CSAM). Attempting to create or distribute CSAM is illegal and prohibited. Detected violations will be reported to appropriate authorities.

8. Payments and Autorenewal

Free users may send a limited number of messages. Further use requires a subscription, billed monthly, quarterly, or annually. Subscriptions renew automatically. Payment is processed at the start of each billing period. Tokens are included with subscriptions and expire at the end of the billing period.

9. Fulfillment Policy

9.1 Cancellation

Subscriptions may be canceled at any time through account settings. Canceled subscriptions remain active until the end of the billing cycle.

9.2 Access upon Cancellation

After cancellation, access reverts to the free version. Unused tokens expire and are not refunded.

9.3 Modifying Subscription Plans

Plans may be upgraded or downgraded, with changes taking effect in the next billing cycle.

9.4 Refund Policy

Refund requests must be made within 24 hours of payment and are denied if more than 20 tokens have been used. Only payments made by card are eligible for refunds.

10. No Guarantee of Accuracy or Perfection

The Services use AI-generated content, which may contain inaccuracies or limitations. We do not guarantee error-free or perfectly tailored outputs. Content moderation may alter requests for safety compliance.

11. Liability

The Services are provided "as is" without warranties of any kind. New Verve Limited is not liable for any damages, including indirect, incidental, or consequential losses arising from use or inability to use the Services.

The Services may link to third-party websites. We do not guarantee their safety or endorse their content. Users are responsible for taking precautions when accessing external links.

13. Governing Law and Dispute Resolution

These TOS are governed by and construed under the laws of England and Wales. Any disputes shall be resolved exclusively in the courts of London, United Kingdom.

14. Changes to Terms

We may update these TOS at any time. Continued use of the Services constitutes acceptance of any changes.

16. Termination and Assignment

You may terminate these TOS by ceasing use of the Services and canceling any subscriptions. We may terminate access at our discretion for violations. We may assign or subcontract Services to third parties.

If any provision is found unenforceable, the remaining provisions remain in effect. These TOS constitute the entire agreement between you and New Verve Limited.

19. Data Protection and Privacy

New Verve Limited processes personal data in accordance with the UK Data Protection Act 2018 and the General Data Protection Regulation (GDPR). We collect and process only the data necessary to operate the Services, improve user experience, and ensure compliance with legal obligations. You agree to indemnify, defend, and hold harmless New Verve Limited, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with:

New Verve Limited shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, government restrictions, power outages, or failures of internet services.

The Services may not be available in all countries or regions. New Verve Limited reserves the right to restrict or block access to the Services where operating is illegal or prohibited by local regulations.
